INSTRUCTIONS FOR COMPLIANCE WITH RULE VII
RULES GOVERNING ADMISSION TO THE ALABAMA STATE BAR

ADMISSION OF NON-RESIDENT ATTORNEYS
PRO HAC VICE

A separate application must be completed for each applicant for each case.

1. Applicant must first associate an attorney who has a current occupational license to practice law in Alabama.

The name of local counsel shall appear on all notices, orders, pleadings and other documents filed in this cause. LOCAL COUNSEL SHALL PERSONALLY APPEAR AND PARTICIPATE in all pretrial conferences, hearings, trials and other proceedings conducted in open court, unless specifically excused by the court or administrative agency.

2. A hearing date is obtained from the court or administrative body where the cause is to be heard. The date is then placed on the form in the appropriate place. The notice of hearing shall be given at least 21 days before the time designated for the hearing, unless the court or agency has prescribed a shorter period. THE HEARING DATE MUST APPEAR ON THE APPLICATION OR THE APPLICATION WILL BE RETURNED.

3. Obtain a current (issued within the previous 60 days) certificate of good standing issued by the bar of the highest state court of the jurisdiction where the applicant regularly practices law. Attach the certificate of good standing to the verified application. (NOTE: certificates of good standing from Federal Courts will be unacceptable.)

4. A verified application is prepared. Applications may be obtained from the Alabama State Bar. PLEASE NOTE, APPLICATIONS WILL BE RETURNED IF:

• All items on the application are not completed

• Any items are deleted or left blank

• Applicant's Social Security Number is left blank

• Items 6-11 are not answered

• Item #12 is incomplete

• The hearing date is not on the application

• The application is not properly signed and notarized

• Current certificate of good standing is not attached

• Certificate of good standing is outdated

5. The original completed verified application is sent to the court or agency with proof of service by mail on the Alabama State Bar in accordance with Rule VII, Rules Governing Admission to the Alabama State Bar, Pro Hac Vice.

6. A copy of the completed verified application and the $300.00 filing fee is sent to the Alabama State Bar. If the court or administrative agency grants a motion to shorten the time for hearing, a copy of the order shortening the time should be attached to the application.

7. The Alabama State Bar shall send a statement to the court prior to the scheduled hearing date. NO APPLICATION SHALL BE GRANTED BEFORE THIS STATEMENT OF THE ALABAMA STATE BAR HAS BEEN FILED WITH THE COURT OR AGENCY.

8. The court or agency issues an order granting or denying the application and sends the order to local counsel.

9. Local counsel sends a copy of the order to the Alabama State Bar within 30 days of the hearing.
